The platform provides advertising and marketing tools (ad serving, impression/click purchasing, optimisation and analytics). We are not a marketplace or a payment intermediary for any third-party transactions of the Client.
B2B use only. The Client must provide accurate company details, keep credentials secure and comply with platform policies.
Fees/volumes are shown in the dashboard or order/invoice. Unless stated otherwise, fees are payable in advance. Bank details:
Payer bears provider fees and FX risk. Amounts are exclusive of taxes; the Client is responsible for applicable taxes/withholdings (net of withholding unless gross-up is agreed in writing).
Billing is based on platform logs and connected measurement providers. Billing disputes must be raised within 10 calendar days from invoice date.
Illegal advertising, counterfeit, malware, spam, adult content, hate speech, sanctions violations and infringement of third-party rights are prohibited. We may throttle, reject or block campaigns/accounts to protect deliverability, reputation and compliance.
The Client represents that all recipient data were collected lawfully and there is a valid legal basis to send communications. Each message must include accurate sender identity and a one-click unsubscribe.
The Client retains rights to its content and grants licences necessary to provide the services. Rights to the platform, software and reports belong to Inotium Limited.
Both parties shall keep Confidential Information secret and use it solely to perform the Agreement.
Services are provided “as is”. No liability for indirect or consequential damages or loss of profits. Aggregate liability is capped at the fees paid during the 3 months preceding the event.
Effective until services end. On termination, the Client has 30 days to request export; afterwards data may be deleted or archived.
We may update these Terms by posting a new version. Unless stated otherwise, updates take effect upon posting.
Hong Kong SAR law; courts of Hong Kong have exclusive jurisdiction. English language governs.
